On May 16, 2026, at approximately 1:44 a.m., an officer observed a white 2009 Nissan SUV traveling westbound on Highway 10 near County Road 15 in the city of Big Lake. According to the complaint, the vehicle crossed the fog line numerous times and then drove along the fog line for several hundred feet. The vehicle’s speed reportedly varied from 65 to 50 miles per hour.
The officer activated emergency lights and stopped the vehicle. The driver was identified as Brandan Daniel Pedrys. While speaking with Pedrys, the officer allegedly noted that his pupils were large and he was sweaty, despite the outside temperature being approximately 55 degrees. Pedrys reportedly stated that he did not have a valid driver’s license.
Pedrys agreed to perform field sobriety tests. During the Horizontal Gaze Nystagmus test, he allegedly had difficulty following instructions and swayed while completing the test. During the one-legged stand, he swayed and reportedly used his arms for balance, placing his foot on the ground at the count of nine. The officer administered a modified Romberg test, which Pedrys allegedly failed, exhibiting eye flutters. After further difficulties with the finger-to-nose test, a preliminary breath test yielded a result of .000.
A search warrant was obtained for a blood or urine sample. At 3:23 a.m., hospital staff collected two vials of the defendant’s blood. According to the complaint, Pedrys has a prior felony conviction for Criminal Vehicular Homicide from November 2019, and his driver’s license had been canceled as inimical to public safety.
